Agreement to Terms
By engaging TitanForge Technology for web design or development services, you agree to these Terms of Service. If you do not agree, please do not proceed with a project. These terms apply to all clients regardless of the service tier selected.
Services
TitanForge Technology provides custom website design and development for small businesses. All work is delivered at a fixed price as specified in the project proposal. Services include:
- Custom website design and development
- Local SEO setup
- Contact form and lead capture integration
- Hosting setup and management
- One round of post-launch revisions
Fixed Price Guarantee
The price in your proposal is final. There are no hourly billing charges, no surprise fees, and no scope creep charges for work within the agreed project scope.
If you request material changes to the project scope after work has begun, a revised proposal will be provided and agreed upon in writing before any additional work starts. You are never obligated to accept a scope change.
Client Responsibilities
To keep your project on schedule, you agree to:
- Provide all required content — text, images, logo, and branding — by the agreed deadline
- Provide feedback within 5 business days at each review stage
- Designate a single point of contact for approvals
- Grant TitanForge access to any necessary accounts (domain registrar, existing hosting, etc.) in a timely manner
Delays caused by missing client content, late feedback, or inaccessible accounts extend the project timeline accordingly and are not the responsibility of TitanForge Technology.
Ownership
Upon receipt of final payment, you own your domain, all website code, and all content. TitanForge Technology retains no ownership rights to the deliverables after the project is complete.
TitanForge Technology reserves the right to display the completed website in its portfolio and marketing materials unless you request otherwise in writing.
Hosting
TitanForge Technology manages hosting infrastructure on your behalf as part of the ongoing service relationship. Your site is hosted on professional infrastructure with automatic deployments and uptime monitoring.
You may request a full transfer of all website files, code, and assets at any time at no charge. We will provide everything you need to take your site elsewhere. No strings attached.
Revisions
Each project includes one round of revisions after the initial build is delivered for your review. A "round of revisions" means a single consolidated list of changes — not multiple back-and-forth cycles.
Additional revision rounds beyond the included one are available at $150 per hour, billed in 30-minute increments, and must be approved in writing before work begins.
Payment
A 50% deposit is required before work begins. The remaining 50% is due upon delivery of the completed website. The site will not be made live or transferred until payment is received in full.
All prices are in US dollars. Payment is accepted via invoice.
Deposits are non-refundable once work has begun. If you cancel a project after work has started, the deposit covers the work completed to that point.
Timeline
Project timelines are best-effort estimates based on your selected service tier:
- Foundation — approximately 2 weeks
- Revenue Engine — approximately 4–6 weeks
- Full System — approximately 6–8 weeks
Timelines begin once the deposit is received and all required client materials have been provided. TitanForge Technology makes every reasonable effort to meet the estimated timeline but cannot guarantee specific launch dates.
Warranties and Disclaimers
TitanForge Technology builds websites to a professional standard and tests across modern browsers and devices prior to launch.
We do not guarantee specific business outcomes such as revenue increases, lead volume, or search engine rankings. Results depend on many factors outside our control including market conditions, competition, and client follow-through.
Websites are delivered "as-is" upon final approval. Future browser updates, platform changes, or third-party service changes may require maintenance. Ongoing maintenance is available separately.
Limitation of Liability
TitanForge Technology's total liability for any claim arising from or related to services provided is limited to the total amount paid by you for those specific services.
We are not liable for any indirect, incidental, special, or consequential damages including but not limited to lost revenue, lost profits, or loss of business opportunities, even if we have been advised of the possibility of such damages.
Governing Law
These terms are governed by the laws of the State of New Jersey. Any disputes arising from these terms or from services provided by TitanForge Technology will be resolved in the courts of Gloucester County, New Jersey.
Changes to These Terms
We may update these terms from time to time. The current version is always available at titanforgetech.com/terms. The "Last updated" date at the top of this page reflects the most recent revision.
